Idle Game Studio1. Acceptance of these Terms
By downloading, installing or playing Idle Game Studio (the "Game"), published by ZAF Games Inc., a company based in Quebec, Canada ("we", "us"), you agree to these Terms, which apply in addition to the terms of the app store you use (Google Play or, when available, the Apple App Store). If you do not agree, do not use the Game.
2. Eligibility
The Game is intended for players aged 13 and older. If you are under the age of majority where you live, you confirm that a parent or legal guardian consents to your play and to any in-app purchases.
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Game on a compatible device you own or control, for personal, non-commercial entertainment only.
4. Data
No account is required to play. Your progress may be tied to your device and may be lost if you uninstall the Game or change devices, unless a backup feature is offered. Your personal data is processed under our Privacy Policy, including the additional rights for players in the Philippines and the EU/Poland described there.
5. Virtual Currency & In-App Purchases
The Game offers virtual currency and items purchased through your app store. Virtual items have no real-world monetary value, cannot be exchanged for cash and are licensed to you, not sold. Prices and limited-time offers are shown before purchase. All purchases are final, except where mandatory consumer law or your app store's refund policy provides otherwise.
Philippines
Purchases are additionally subject to Philippine consumer protection law (RA 7394) where mandatory.
Poland / European Union
You generally have a 14-day right of withdrawal for digital content, which is lost once you expressly consent to immediate delivery and acknowledge the loss of that right at purchase, in line with Directive 2011/83/EU as implemented in Poland.
6. User Conduct
- No cheating, exploiting bugs, or using unauthorized third-party software.
- No harassment, hate speech or illegal content in any communication feature, including our Discord community.
- No reverse engineering, reselling or commercial exploitation of the Game.
7. Intellectual Property
All game content, code, art and trademarks are owned by ZAF Games Inc. or its licensors and protected by applicable intellectual property law. All rights not expressly granted are reserved.
8. Changes to the Game or Service
We may update, modify, suspend or discontinue the Game or any feature, including virtual items, with reasonable notice where practicable and where required by law.
9. Disclaimer & Limitation of Liability
To the maximum extent permitted by law, the Game is provided "as is" and ZAF Games Inc. is not liable for indirect, incidental or consequential damages arising from its use. Nothing in these Terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded or limited under mandatory consumer protection law where you live (including in Quebec, the Philippines and the EU).
10. Termination
We may suspend or terminate your access for violation of these Terms, at our reasonable discretion and consistently with mandatory consumer protection rules. You may stop using the Game at any time by uninstalling it.
11. Governing Law & Disputes
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, and the competent courts of Quebec have jurisdiction. If you are a consumer, you keep the benefit of the mandatory consumer protection laws and the right to bring proceedings before the courts of your country of residence where those laws give you that right. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. General
If any provision is found unenforceable, the rest remains in effect. We may update these Terms and will notify you of material changes in advance where required by law; continued use after changes take effect means you accept them.
13. Additional Terms for Apple Devices
If you download the Game from the Apple App Store: (a) these Terms are between you and ZAF Games Inc., not Apple, and we alone are responsible for the Game and its content; (b) Apple has no obligation to provide maintenance or support for the Game; (c) if the Game fails to meet an applicable warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation; (d) we, not Apple, are responsible for any claims about the Game, including product liability, legal compliance and consumer protection claims; (e) Apple is not responsible for intellectual property claims relating to the Game; (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once you accept them; and (g) you confirm you are not located in a country under a U.S. government embargo or listed as a restricted party, and that you will respect applicable third-party terms, such as your wireless data service agreement.
